Terms of Service

Draft — pending legal review and may change before launch.
Blixcy is an online platform where independent adult creators publish content and members choose to subscribe to it. It is operated by the company that operates Blixcy ("we", "us"). By entering the site or creating an account you agree to these Terms, our Privacy Policy, Community Guidelines and Consent & content policy. Creators also accept the Creator Agreement.
1. Our role
We provide hosting and tools. Creators are independent: they are not our employees, agents or partners, and they alone are responsible for the content they publish. We do not create, pre-approve or endorse creator content. We act as an intermediary and respond to notices, reports and lawful orders as described in our Moderation policy.
2. Eligibility and restricted territories
- You must be at least 18, or the age of majority where you live if higher. We may ask you to verify your age or identity at any time.
- Every post is rated General or Adult. Adult-rated content is not shown in, or accepted from, certain territories because publishing or viewing it there may be unlawful. Currently restricted: IN. From there you can use Blixcy for General content only, and you must not use a VPN, proxy or similar tool to get around the restriction.
- You are responsible for making sure that viewing adult content is lawful where you are, including when you travel.
3. Your account
Give accurate information, keep your password secret, and tell us promptly if you suspect misuse. You are responsible for activity under your account. One person, one account; you may not sell or share accounts.
4. Content and licence
Creators keep ownership of what they upload. By publishing, a creator grants Blixcy a worldwide, non-exclusive, royalty-free licence to host, store, cache, resize, watermark, display, distribute to entitled members and promote the content on and for the platform, for as long as it is published and for a reasonable period afterwards to complete deletion from backups. Deleting content or an account ends the licence going forward; copies kept as legally required (see Privacy) are not displayed.
5. What you may not do
Do not post or do anything described in the Community Guidelines or the zero-tolerance list in the Consent policy. In short: no one under 18 in any form, no content shared without the consent of everyone depicted, no coercion or trafficking, no impersonation or deepfakes of real people without consent, no illegal content, no scams, no harassment, no doxxing, no malware or scraping, and no infringement of anyone's rights.
6. Payments
Prices are set by creators and shown before you pay. Payments are handled by third-party payment processors; we do not store your card details. Memberships renew until cancelled. See Refunds & cancellation. Taxes are shown or applied as required by law.
7. Enforcement
We may remove content, restrict features, suspend or terminate accounts, and withhold payouts where we believe these Terms or the law have been breached, or where we are required to by a court or authority. Where we can, we tell you why and how to appeal. We may act first and explain afterwards where children, non-consensual content or legal orders are involved. We report suspected child sexual abuse material and other serious offences to the relevant authorities.
8. Complaints and appeals
Use the Grievance officer page for complaints and for appeals against moderation decisions. We acknowledge within 24 hours and aim to resolve within 15 days.
9. Disclaimers
The service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free service, or the accuracy, legality or quality of creator content. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Limitation of liability
To the extent the law allows, our total liability to you for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim (or, for creators, the fees we earned from you in that period), and we are not liable for indirect or consequential loss, lost profits, or loss caused by creator or member content.
11. Indemnity
You will cover our reasonable losses and legal costs arising from content you publish, your breach of these Terms, or your breach of law or third-party rights.
12. Who these Terms are with
These Terms are a contract between you and the company that operates Blixcy only. They do not create any duty owed to you by our individual directors, officers, employees or contractors, and you agree not to bring claims relating to the service against them personally, except where the law does not allow that limit (for example, for their own fraud).
13. Governing law
These Terms are governed by the law of the place where our operating company is registered (to be stated here once the company is incorporated), and its courts have jurisdiction, except where mandatory consumer law gives you the right to use your local courts.
14. Changes
We may update these Terms. If a change is material we will ask you to accept the new version before you continue (the 18+ gate is shown again). Continued use after a minor change means you accept it.
